Welcome to Jayir. These Terms of Service (“Terms”) govern your access to and use of our website [www.jayir.com] (the “Site”) and services (collectively, the “Platform”) operated by Jayir (“we”, “us”, or “our”).

By accessing, browsing, registering, or using any part of the Platform—whether as a buyer, seller, or visitor—you agree to be legally bound by these Terms. If you do not agree to these Terms, do not access or use the Platform.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction, whichever is higher, to use our Platform. If you are underage, you may only use Jayir under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.

2. User Accounts

To access certain features, both buyers and sellers must register for an account. You agree to:

Provide accurate and complete information during registration.
Maintain the confidentiality of your login credentials.
Notify us immediately of any unauthorised use or security breach.

You are fully responsible for any activity under your account, even if not authorised by you.

3. Buyer Terms

As a buyer, you may browse, place orders, and make payments through the Platform.

You agree to pay all applicable charges, including product prices, shipping, and applicable taxes.
Placing an order constitutes a legally binding offer to purchase the product.
We or the seller may cancel or refuse orders for various reasons, including but not limited to stock availability, pricing errors, or violation of the Terms.

4. Seller Terms

As a seller on Jayir, you agree to:

Only list original, handmade, authentic, or ethically sourced products that comply with local and international laws.
Fulfil all orders promptly and communicate transparently with buyers.
Grant Jayir a non-exclusive, royalty-free license to use your product images and descriptions for marketing purposes.
Pay applicable commissions and/or service fees as per our vendor agreement.

Violation of seller guidelines may result in suspension or termination of your account.

5. Marketplace Role & Responsibilities

Jayir acts as a neutral platform connecting buyers and sellers. We are not the manufacturer, wholesaler, or direct seller of any products listed by third-party vendors.

We do not:

Guarantee the authenticity, legality, or quality of listed products.
Mediate disputes unless escalated via our support channel.
Store or directly ship products unless explicitly stated.

6. Payments & Fees

Jayir uses third-party payment gateways. By using our platform, you agree to the terms of these processors. We do not store your card or UPI information.

Buyers: Payment is collected at checkout. You will receive order confirmation and shipping details thereafter.
Sellers: Payouts are released after successful order delivery and deduction of platform commission and applicable taxes.

All prices are listed in INR unless otherwise stated.

7. Returns, Refunds & Cancellations

Buyers and sellers must adhere to Jayir’s return and cancellation policy, which includes:

Buyers must raise return/refund requests within [X] days of delivery.
Sellers must honor returnable orders and cooperate with reverse logistics.
Some products (e.g., custom, perishable, GI-tagged with no resale value) may be non-returnable.
Jayir will mediate disputes when raised formally, but the final decision rests with us.

8. Intellectual Property

All content on the Platform, including but not limited to text, images, logos, graphics, and software, is either owned by Jayir or licensed to us. You may not:

Copy, modify, reproduce or distribute any part of the Platform content.
Use our brand or trademarks without prior written permission.

Sellers retain ownership of their product photos and descriptions but grant Jayir a license to display and market them.

9. Prohibited Activities

Users agree not to use the Platform for:

Any unlawful purpose, including the sale of banned items.
Uploading false, misleading, defamatory, or infringing content.
Sending malware, spam, or engaging in scraping or crawling of the website.
Impersonating others or creating fake accounts.
Collecting user data without consent.

Violation may result in account suspension, legal action, or permanent ban.

10. Third-Party Services

We may offer integrations with third-party services (e.g., logistics providers, payment gateways). We are not responsible for their performance, security, or policies. Your use of these services is at your own risk and subject to their terms.

11. Privacy

Your use of the Platform is governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

12. Limitation of Liability

Jayir shall not be liable for any indirect, incidental, punitive, or consequential damages arising from:

Your use or inability to use the Platform.
Product defects or delivery issues.
Unauthorised access to your account.

Our total liability shall not exceed the amount paid by you (buyer or seller) in the last 30 days.

13. Termination

We reserve the right to:

Terminate or suspend your access at any time, with or without cause.
Remove listings or content that violates our policies.
Withhold payouts in case of fraud or disputes.

You may delete your account at any time by contacting our support.

14. Changes to Terms

We may revise these Terms at any time. Continued use of the Platform after changes means you accept the revised Terms. We will notify users via email or platform notifications where required by law.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Siliguri, West Bengal.
